Scope, Definitions, and Precedence
"This App" refers to the AI Inc. application; "This Site" refers to the introduction, help, and AI-learning website located at or under lumo.tokyo/ai-inc; "This Service" encompasses these elements and related support; and "User" refers to any individual who uses them.
For software licensed via the App Store, the Apple Standard End User License Agreement (Standard EULA) applies, unless a separate, legally presented license agreement is provided. These Terms of Service supplement the service-specific conditions and do not replace the Apple Standard EULA. In the event of any conflict regarding the license, the applicable EULA shall prevail; furthermore, mandatory legal provisions (statutory requirements) always take precedence.
Personal information is handled in accordance with the Privacy Policy, while sales conditions are governed by the disclosures required under the Act on Specified Commercial Transactions as well as information provided at the time of purchase. Simply browsing this site does not constitute a paid contract. Where consent to these terms is required by law, it will be obtained through appropriate means.
Eligibility, Technical Requirements, and Third-Party Services
This App does not require a separate, dedicated user registration. Please refer to the App Store product page (as it appeared at the time of release) and the information provided within this app for details regarding compatible devices, operating systems, and age ratings. If a minor wishes to make a purchase, they must obtain the necessary consent from a legal guardian and comply with all applicable laws and Apple’s procedures.
Users are responsible for providing and covering the costs of their own devices, network connectivity, and storage space. Features such as iCloud synchronization require a compatible Apple Account, specific settings, and an appropriate network environment; we do not guarantee indefinite compatibility with all devices, operating systems, or external services.
Apple and other external services are subject to the terms and conditions of their respective providers. While the operator cannot control the specifications of—or technical issues arising from—third-party services, this does not exempt the operator from their own legal liabilities regarding this service. Obligations to and rights concerning Apple are governed by the applicable End User License Agreement (EULA) and relevant laws.
Nature of Simulation and Learning Information
Companies, models, learning/evaluation results, stocks, valuations, investments, loans, and funds are purely fictional game elements. They do not represent real-world bank deposits, securities, transferable currency, or financial instruments; they cannot be converted into cash, nor do they grant any right to claim dividends or other real-world financial gains. This content does not constitute professional advice on investment, business management, or legal matters.
The learning material about AI on this site is intended solely to assist with general understanding. We do not guarantee the measured accuracy of specific models, the reproducibility of research findings, or any specific business outcomes. For practical applications or critical decision-making, please consult original source materials and seek appropriate professional advice. References to real-world names, buildings, or research do not imply any partnership, endorsement, or validation of the data presented.
Standard in-game learning and evaluation processes do not involve sending data to external generative AI services for training purposes. Should we introduce features in the future that involve transmitting data to external services, we will clearly disclose the details and obtain the necessary consent at that time.
Saving, Syncing, Exporting, and Deleting
Users (or the rightful rights holders) retain all rights to the content they input; copyright is not transferred to the operator. Please do not input or share the personal or confidential information of others.
Data is saved locally on your device by default. iCloud synchronization is optional and disabled by default. Synchronization and restoration are subject to various factors—such as network connectivity, Apple’s service availability, available storage space, and data compatibility—which may occasionally lead to conflicts or delays. Please note that synchronization does not function as a comprehensive backup capable of restoring every past state of your data.
To protect against device failure, loss, accidental app deletion, insufficient storage, or OS changes, please ensure you maintain your own backups or exported data files. Deleting data from your device or disabling synchronization does not automatically remove copies stored in iCloud or other export destinations. The operator cannot remotely restore local device data that it does not hold. Data handling is governed by our Privacy Policy, and liability for damages is subject to the "Scope of Liability" section of these Terms.
Privacy policy →Sales, Fees, Payments, and Refunds
This app is intended for sale exclusively via the App Store as a one-time, non-subscription purchase. There are no recurring charges or automatic renewal agreements. This website does not process purchase requests, advance payments, or credit card information. Please refer to the App Store product page, the purchase confirmation screen, and the disclosures required by the Act on Specified Commercial Transactions for details regarding pricing (including tax), service features, payment methods, and availability. Any unannounced pricing or release dates are subject to change and are not guaranteed.
All transactions are processed through systems provided by Apple. Terms regarding purchase authorization, payment, and downloads are governed by Apple’s policies; the operator does not directly receive or store your credit card information or similar payment details. Re-downloading and similar actions are subject to the Apple Account used for the purchase, the availability of the content, and Apple’s terms and conditions.
If you wish to request a refund, please use Apple’s refund request process. Whether a refund is granted and how it is processed will be determined in accordance with Apple’s terms and applicable laws. In the event of technical issues or content that differs from its description, the operator will also provide support; nothing herein shall be construed to exclude any rights provided by law, such as the right to request repairs, contract termination, refunds, or compensation for damages.
Request a refund from Apple ↗Intellectual Property and Licensing
Rights to the programs, designs, text, images, trademarks, and other elements of this service belong to the operator or the respective rightful owners. Users may utilize this application within the scope of the applicable End-User License Agreement (EULA) and the law; however, users may not reproduce, sell, redistribute, or sub-license the service itself without explicit authorization.
Nothing in these terms limits rights granted by law (such as the right to quote), licenses applicable to open-source components, or rights permitted under Apple’s terms and conditions. When sharing actual in-game footage, please be mindful of the rights and personal information of third parties, and ensure that your content does not create the false impression that it is an official communication from the operator or an authorized partnership.
Prohibited Conduct
Activities that violate laws or public order and morals, infringe upon the rights or privacy of others, involve impersonation or fraud, or entail the unauthorized acquisition of purchase or usage rights are strictly prohibited.
Unauthorized access, the transmission of malicious software, the circumvention of security measures, placing an excessive load on the service beyond normal usage, and interfering with, threatening, or persistently harassing the service or its support operations are prohibited. Furthermore, providing benefits to, or engaging in transactions with, anti-social forces (such as organized crime groups), making violent demands, or abusing your relationship with the operator is strictly prohibited.
Reverse engineering (including decompilation and disassembly) and the unauthorized sale or distribution of data or software belonging to others are prohibited, except where permitted by law or an applicable license. The operator will not arbitrarily determine whether a violation has occurred, nor will it impose a blanket prohibition on uses that are legally permitted.
Measures in the Event of a Violation; Termination of Use
In the event of a serious violation or if required for safety reasons, the operator may restrict access to support sites or other services under its management, to the extent necessary and reasonable. Where reasonably practicable, the operator will provide notice of the reason and the steps required for remediation, and will offer an opportunity to rectify the issue. In cases involving imminent danger, unauthorized access, or similar situations, protective measures may be taken without prior notice.
These Terms do not grant the operator the authority to remotely delete data—such as save files—from a user’s device or Apple Account at its own discretion. The termination of any purchased usage rights shall be governed by the End User License Agreement (EULA) and applicable laws. Please contact our support desk if you wish to contest any measures taken. While users may cease using this application, the deletion of data must be performed manually at the respective storage location.
Modifications, Interruptions, and Discontinuation of Service
The service, or parts thereof, may be modified or interrupted due to maintenance, bug fixes, responses to unauthorized use, changes to operating systems or external services, natural disasters, or communication failures. Please note that game adjustments do not guarantee the preservation of past results, nor do they ensure compatibility with all future environments.
Except in urgent or unavoidable circumstances, the operator will provide reasonable advance notice regarding any changes that significantly impact the use of the service, or regarding the discontinuation of the service, including details on the nature of the changes and the timing. Taking into account safety and technical constraints, the operator will provide guidance on procedures such as data retrieval. In cases affecting obligations related to paid services, the operator will take necessary actions in accordance with applicable laws and Apple’s established procedures.
Scope of Warranty
While we provide this service with reasonable care, we do not unconditionally guarantee that it will be free from interruptions or errors, compatible with all user environments, capable of achieving specific purposes or results, or that stored data will be retained permanently. Nothing in this statement shall negate any specific commitments made to the user, nor shall it affect any rights—such as those regarding quality or remedies—guaranteed by law.
Liability for issues arising from failures in external services or from the user’s own environment shall be determined based on the respective causes and the party to whom the fault is attributable. Describing the service as being provided "as is" does not constitute a blanket waiver of the operator’s liability for breach of contract or of any statutory remedies available to the user.
Scope of Liability
If a user incurs damages due to reasons attributable to the operator, the operator shall be held liable in accordance with applicable law. The limitations set forth in the following paragraph shall not apply to damages resulting from the willful misconduct or gross negligence of the operator, its representatives, or its agents/auxiliaries.
Only for loss caused by ordinary negligence, excluding intentional misconduct and gross negligence, and only to the extent permitted by law, recoverable damages are limited to ordinary, direct, actual loss. Total liability is capped at the greater of all fees the user actually paid for AI Inc. or JPY 10,000. These limits do not apply to death or personal injury, liability that mandatory law does not allow us to limit, or statutory rights to repair, termination or refunds. Any legally invalid restriction does not apply.
If a user causes damage to the operator or a third party through an unlawful act resulting from the user’s own intentional misconduct or negligence, liability shall be determined in accordance with applicable law. These terms do not impose strict liability (liability without fault) or unlimited indemnification obligations upon the user, nor do they grant the operator the right to unilaterally determine the existence or scope of its own liability.
Changes to Terms and Notification
Any changes to these terms (when treated as "standard terms and conditions" under the Civil Code) shall be implemented in compliance with Article 548-4 of the Civil Code and other applicable legal requirements. The operator will provide notice of the changes and their effective date on this website or through other appropriate channels, allowing for a reasonable period of advance notice. For any other changes requiring user consent, such consent shall be obtained. Merely accessing the website after changes have been made shall not be construed as consent to any changes that are disadvantageous to the user.
Important information will be communicated via methods appropriate to the nature of the notice, such as through displays on this website or within the applicable application. Responses to individual support inquiries or billing-related matters will be provided via email or similar means.
Rights, Obligations, and Severability
Except as permitted by law or the End-User License Agreement (EULA), users may not assign or resell their contractual status or usage rights without the operator's consent. In the event that personal data is transferred—for instance, due to a business succession—such transfer shall be conducted in accordance with applicable laws and our Privacy Policy.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to remain in effect to the fullest extent permitted by law. An invalid provision shall not be automatically replaced by a term that is disadvantageous to the user. Following the termination of these Terms, provisions that by their nature must survive—such as those concerning intellectual property, liability, and dispute resolution—shall remain in effect to the extent permitted by law.
Governing Law, Jurisdiction, and Language
These Terms are governed by the laws of Japan. However, this does not deprive users of any rights granted under mandatory consumer protection laws or other applicable regulations in their place of residence. In the event of a dispute, the parties shall engage in good-faith consultations; if a resolution cannot be reached, the matter shall be handled by a court with competent jurisdiction as provided by law. Engaging in such consultations or contacting our support channels is not a mandatory prerequisite for filing a lawsuit or pursuing other legal remedies.
The Japanese version of these Terms serves as the original text; versions in other languages are provided for reference only. In the event of any discrepancy, the handling of such matters shall not infringe upon the protections afforded to users under applicable mandatory laws.
